Baker v. Blue Cross sent shockwaves through the legal and insurance industries when a jury ordered Blue Cross to pay the plaintiff $1,500,000 for punitive damages, in addition to the long term disability benefits in dispute, agggravated damages, and legal expenses of more than $1,000,000. The case was appealed, with the Ontario Court of Appeal not only upholding the decision, but also highlighting some of the conduct that warranted such a precedent setting award.
